Mission of the Agency
The Railway Regulatory Agency is established to provide transparent and non-discriminatory work of the Manager of the Infrastructure of the Transporters, the Bodies and the institutions connected with the work of the railway, as well as other participants that provide railway services in the railway public transport and functioning of the railway sector in the Republic of North Macedonia.
The Railway Regulatory Agency works pursuant to the Law on Railway System (hereinafter: the Law) and the Statute of the Agency. The Agency, in its work and decision making process, in the framework of its competences, is independent from other state bodies, other public legal entities and trade unions executing activities in the area of railway services.
In order to exercise its competences, pursuant to the Law on railway System, the Agency shall be authorized to:
• Define and control the criteria for quality of the railway services provided by the railway operators and infrastructure managers
• Monitor the respect of the rights of passengers
• Ensure that the fee for access to the infrastructure provided by the infrastructure manager in non-discriminatory, pursuant to Law on Railway System;
• Undertake measures for prevention from unfair and discriminatory behaviour by the infrastructure manager and each transporter or applicant for infrastructure capacity;
• Undertake measures for prevention from unfair and discriminatory behaviour between two or more railway operators in providing railway transport services;
• Undertake measures for prevention from unfair and discriminatory appliance of the network statement and the framework agreements;
• Approve the charges in cases of congested infrastructure, if the capacity plan cannot be implemented or if the proposed solutions are not economically and financially profitable;
• Control over the access and the use of the service facilities and the stable premises which are not managed by the railway infrastructure manager, but are regulated by the agreement between the service provider and one or more railway operators;
• Issue Licenses for Public Railway Transport;
• Issue Licenses for Transport for One’s Own Use;
• Issue Licenses for Railway Infrastructure Management;
• Adopt and Implement bylaws pursuant to the Law on Railway;
• Enforce management procedures and adopt decisions in management procedure pursuant to the Law on Railway and the Law on General Management Procedure;
• Provide opinion and participate in drafting laws, bylaws and other acts that refer to the railway services, including the ratification and the accession of the Republic of North Macedonia in international agreements in the area of railway;
• Hold a Registry on Issued, Annulled, Withdrawn Licenses for Public Railway Transport Issued to Transporters and Licenses for Railway Infrastructure Management Issued to a Manager of Infrastructure;
• Monitor the railway market aiming to analyze the competition between different types of transport and
• Monitor the Competition on the railway services market, including the railway freight market.
